VOTER BILL OF RIGHTS
1. You have to right to cast a ballot if you are a valid registered voter. A valid registered voter means a United States citizen, a resident in this state, at least 18 years of age and not in prison or on parole for conviction of a felony and who is registered to vote at his or her current residence address.
2. You have to right to cast a provisional ballot if your name is not listed on the voting rolls (Roster of Voters). 3. You have to right to cast a ballot if you are in line at the polling place prior to the close of the polls.
4. You have to right to cast a secret ballot free from intimidation. 5. You have to right to receive a new ballot if, prior to casting your ballot, you believe you made a mistake. If at any time before you cast your ballot, you feel you have made a mistake, you may exchange the spoiled ballot for a new bal- lot. Vote-by-mail voters may also request and receive a new ballot if they return their spoiled ballot to an election official prior to the closing of the polls on Election Day. 6. You have to right to receive assistance in casting your ballot, if you are unable to vote without assistance. 7. You have to right to return a completed vote-by-mail ballot to any precinct in the county. 8. You have to right to election materials in another language, if there are sufficient residents in your precinct to warrant production. 9. You have to right to ask questions about election procedures and observe the elections process. You have the right to ask questions of the precinct board and election officials regarding election procedures and to receive an answer or be directed to the appropriate official for an answer. However, if persistent questioning disrupts their duties, the board or election officials may discontinue responding to questions. 10. You have to right to report any illegal or fraudulent activity to a local election official or to the Secretary of State’s Office. Available at all polling places: (Or everyone is welcome to use:) Personal assistance: You may bring up to two people, including pollworkers (no employers/union representatives), into the voting booth for assistance in marking the ballot. Accessible voting machine: A voting machine with touch-screen and audio ballot and ports for your personal devices (sip-and-puff, pedal) to allow you to vote independently and privately. Curbside voting: If you cannot enter a polling place, pollworkers can bring mate- rials for you to vote outside the polling place. Reading tools: Large-print instructions on how to mark a ballot and optical sheets to magnify print are available. The accessible voting machine provides large print text on the screen, and you can further increase text size. Seated voting: A voting booth that allows voting while seated. Voting Tools: Easy-grip pens for signing the Roster and marking the ballot. PROVISIONAL VOTING
You have the right to cast a provisional ballot if your eligibility cannot be determined at the polling place because: You were issued a vote-by-mail ballot that you do not have, and you want to vote at the polls; You are a registered voter whose name does not appear in the precinct’s Roster of Voters; You have moved within San Francisco but did not re-register to vote; or You registered with a different political party than is printed next to your name in the Roster in a Primary Election.
Casting a Provisional Ballot: A pollworker will issue a provisional envelope and your ballot. Complete all fields on the envelope. Mark the ballot, seal it in the envelope, and place it into the secured ballot container. Keep the receipt from the envelope to track your Provisional Ballot. Check the status of your provisional ballot starting 29 days after the election by calling the number listed on the provisional envelope receipt, or visit www.sfelections.org/pv/ and provide the envelope receipt number and your date of birth.
PROHIBITED ACTIVITIES
Electioneering: Audibly or visibly advocating for or against an item on the bal- lot and is not allowed within 100 feet of a polling place room entrance. Please remove or cover campaign materials and do not state opinions or information about a candidate or ballot measure. (site code or no?)
Fraudulent Voting: It is a crime punishable by imprisonment for anyone to fraud- ulently vote, fraudulently attempt to vote, vote more than once, attempt to vote more than once, impersonate a voter, or attempt to impersonate a voter. Tampering with Voting Equipment: It is a crime punishable by imprisonment for anyone to tamper with voting equipment.
WHEN IS ID REQUIRED?
Identification is only required if you did not provide enough information when registering to vote. If you did not provide this information when registering to vote you will be listed in the Roster of Voters as ‘ID Required’. To vote a regular ballot, present a pollworker with identification or doc- ument establishing identity. Acceptable documents are in listed in the Help America Vote Act (HAVA) registration rules section of the Roster of Voters. If you are not able to show any of the listed forms of identification, may vote a provisional ballot.
VOTING INSTRUCTIONS
Getting a Ballot: Your name is listed in the Roster of Voters of the precinct where you live and are registered to vote. Tell the pollworker your name and address. A pollworker will confirm your name and address, and find your name in the Roster of Voters. Sign next to your name. A pollworker will give you a secrecy folder, paper ballot cards, receipt stubs from the ballot, and a pen (unless you request to vote a touchscreen or audio ballot). A sign on the Election Table shows you the number of cards you will re- ceive.
Marking Your Ballot: Connect the arrow pointing to your choice for each contest, as shown in the picture. The ballot may be printed on both sides of the page—be sure to review both sides.
Preventing an Overvote: For each contest, the number of candidates you may select for each con- test or choice will be printed above the list of candidate names. If you mark more than the allowed number of candidates, your vote for that contest cannot be counted.
Voting for a Write-in Candidate :To vote for a Write-in Candidate, draw a line connecting the arrow pointing to the “Write-in” space and write the candidate’s name in the space to the left of the arrow. Only votes for Certified Write-in candidates can be counted. The list of Certified Write-in Candidates is available at the Election Table.
Correcting a Mistake: If you make a mistake on your ballot, take the card to the Election Table to get a replacement. You may replace up to two complete sets of ballot cards.
Marking a Ranked-Choice Ballot: Ranked-choice voting allows voters to rank up to three candidates for some San Francisco municipal offices. Please see ranked-choice voting instructions in the voting booth, on the ballot, and the Voter Information Pamphlet.
Casting Your Vote: Insert your ballot, one card at a time, into the slot in the front of the voting machine. The voting machine counts the votes electronically as the ballot is inserted and then deposits the ballot in a locked compartment under the machine.
